Terms & conditions
Short, plain-language terms for using this site and sending us an order request. Nothing here is boilerplate theater — it describes how we actually work.
Last updated: November 1, 2026
1. About these terms
These terms govern your use of the Whimwhirl Confections website (this site) and the order request process available on it. By sending us an order request, you confirm that you have read these terms. If you don't agree with them, please don't send a request — and tell us what's wrong with them, because we're open to being corrected.
2. An order request is not an order
This website has no shopping cart and no online payment, by design. Sending an order request asks us to reply with availability, pricing, and pickup or shipping options. Nothing is sold, reserved, or charged until we confirm the details with you by email or phone and you agree to proceed. Until that point, both sides can walk away without obligation.
3. Availability and small batches
We make candy in batches of forty to eighty pieces. Flavors rotate, and batches genuinely sell out — that's real scarcity, not a marketing strategy. The candies shown on this site may not all be available at any given moment. We'll always tell you what's in the current batches when you request an order, and we won't sell you something we don't have.
4. Ingredients, allergens, and honesty
We deliberately do not publish ingredient lists; part of the experience is the mystery, and batches change too often for a printed list to stay accurate. Most of our recipes contain dairy-derived butter, and our kitchen handles wheat and soy products, so we cannot guarantee that any candy is allergen-free, vegan, or gluten-free. If you have a food allergy, a sensitivity, or a specific diet, contact us before ordering — we'll tell you honestly what's in the current batches and what we can and cannot do.
We make no medical, nutritional, or therapeutic claims about our candy. It's candy: it's sugar, it's a treat, and it is not a substitute for anything except a treat.
5. Storage and shelf life
Store unopened candy cool, dry, and away from direct sunlight. Unopened lollipops hold their texture for six to twelve months; caramels are best within six months. Hand-made candy contains no preservatives, so it will not last as long as mass-produced candy — that's the trade-off we've chosen. Once opened, we'd say enjoy it within a couple of weeks.
6. Shipping
We ship within the United States. Hard lollipops travel well year-round; caramels and ribbon candy are best shipped in cooler weather, and we'll advise honestly based on current conditions when we confirm your order. Once a confirmed order is handed to a carrier, it's in their care — we pack carefully, but we can't promise what happens in a hot mailbox. Delivery times are the carrier's estimate, not a guarantee on our part.
7. Returns
Candy is a food product, so we can't accept returns of opened or tasted boxes. If something arrives damaged in transit, contact us within three days with a photo and we'll make it right, usually with a replacement from a current batch. If a flavor simply wasn't to your taste, tell us anyway — feedback goes into our notebook and shapes what we make next.
8. Custom and event orders
Custom flavors, gift boxes, and event candy are quoted case by case. Please allow three weeks' notice for new flavor combinations; the current lineup can often move faster. Final details — flavors, quantities, delivery date, and total price — are confirmed in writing before any custom order is made.
9. Intellectual property
The name Whimwhirl Confections, the site's content, photographs, and the signature swirl designs are ours. You're welcome to share links to the site; you're not welcome to copy the candy, the name, or the photographs for commercial use without asking. We'd probably say yes — ask.
10. Limitation of liability
To the extent permitted by law, Whimwhirl Confections and its owners are not liable for any indirect, incidental, or consequential damages arising from your use of this site or from your purchase of our candy, except that nothing in these terms excludes liability we can't exclude under applicable law.
11. Privacy
The personal information you submit through the order request form is handled as described in our privacy policy.
12. Governing law
These terms are governed by the laws of the State of Minnesota, United States, without regard to conflict-of-law provisions. Disputes are subject to the exclusive jurisdiction of the state and federal courts located in Hennepin County, Minnesota.
13. Changes to these terms
We may update these terms from time to time. The "last updated" date above tells you when we last revised them. Continued use of the site after a revision means you accept the updated terms. If a change is material, we'll note it here.
